These Terms and Conditions govern your access to www.scarcity.place and any purchase you make from Scarcity Limited, trading as Scarcity (“Scarcity”, “we”, “us” or “our”).
By using our website or placing an order, you agree to these Terms and Conditions, our Privacy Policy and our Returns and Exchanges Policy.
## 1. New Zealand consumer law
Nothing in these Terms and Conditions excludes, restricts or modifies any right or remedy that cannot lawfully be excluded, including rights under the Consumer Guarantees Act 1993 and Fair Trading Act 1986.
If you acquire products from us for personal or household use, you may have rights and remedies in addition to those contained in these terms.
## 2. Using our website
You may use our website only for lawful personal or business purposes.
You must not:
* Use the website fraudulently or unlawfully.
* Attempt to gain unauthorised access to the website or another person’s account.
* Introduce malware, harmful code or other disruptive material.
* Scrape, copy or extract website content using automated systems without permission.
* Interfere with the website’s security or operation.
* Use our content or intellectual property in a misleading or unauthorised manner.
* Place orders for fraudulent resale, payment abuse or other unlawful activity.
We may restrict or suspend access where we reasonably believe these terms have been breached.
## 3. Eligibility to order
By placing an order, you confirm that:
* You have legal capacity to enter into the transaction or have permission from a parent or guardian.
* The information you provide is accurate and complete.
* You are authorised to use the selected payment method.
* You are purchasing for lawful purposes.
## 4. Product information
We make reasonable efforts to ensure product descriptions, photographs, measurements, colours and other information are accurate.
Colours may appear differently depending on your device, screen settings and lighting. Measurements may vary slightly due to manufacturing processes and the way products are measured.
These reasonable variations do not affect your rights where a product is materially different from its description or otherwise fails to meet a legal guarantee.
Product availability is not guaranteed until an order has been accepted.
## 5. Sizing
Customers are responsible for reviewing the relevant product measurements and size guide before placing an order.
Sizing may differ between products, collections or manufacturers. Selecting an incorrect size is treated as a change of mind unless the product is incorrectly labelled, materially inconsistent with our stated measurements or incorrectly supplied by us.
## 6. Prices and currency
Unless stated otherwise:
* Prices are displayed in New Zealand dollars.
* Prices include GST where applicable.
* Delivery charges are shown separately at checkout.
* International customs duties, taxes and import charges are not included.
We may change prices at any time, but a price change will not affect an order that we have already accepted.
## 7. Orders and acceptance
Submitting an order is an offer to purchase the selected products.
An automated order confirmation acknowledges that we have received your order but does not necessarily mean that the order has been accepted.
We may decline or cancel an order before dispatch where reasonably necessary, including where:
* A product is unavailable.
* Payment has not been authorised.
* We reasonably suspect fraud or misuse.
* An obvious pricing or product-information error has occurred.
* A delivery restriction applies.
* A quantity limit has been exceeded.
If we cancel an order after taking payment, we will refund the relevant amount to the original payment method.
A contract for the sale of a product is formed when we confirm acceptance or dispatch the product, whichever occurs first.
## 8. Payment
You must pay the total amount displayed at checkout using one of the available payment methods.
Payment services may be provided by third-party processors and may be subject to additional provider terms.
We are not required to dispatch an order until payment has been successfully completed or authorised.
## 9. Pricing and website errors
We may correct genuine typographical, technical or pricing errors.
Where an obvious error affects an order, we will contact you as soon as reasonably possible and offer you the option to:
* Proceed at the correct price.
* Select an alternative product.
* Cancel the affected product or order for a full refund.
We will not substitute a product or charge a higher price without your agreement.
## 10. Order changes and cancellations
Contact scarcitynz@gmail.com immediately if you need to change or cancel an order.
We will make reasonable efforts to accommodate your request, but we cannot guarantee changes or cancellations after an order has entered processing or been dispatched.
Where an order has already been dispatched, our Returns and Exchanges Policy will apply.
## 11. Preorders
Where we offer a product for preorder:
* The estimated dispatch date will be displayed on the product page or communicated separately.
* Estimated dates may change due to production, freight, customs or other delays.
* We will notify you of a material delay when reasonably possible.
* Products ordered with a preorder product may be held and shipped together unless otherwise stated.
* You may contact us to request cancellation before dispatch.
Nothing in this section limits rights relating to unreasonable delivery delays under New Zealand law.
## 12. Delivery
Delivery options, charges and estimated timeframes are displayed at checkout or on our Shipping Policy page.
You are responsible for providing a complete and accurate delivery address. Contact us immediately if you notice an error.
Delivery estimates are estimates rather than guaranteed dates unless we expressly agree to a specific delivery date. We will take reasonable steps to deliver within the stated timeframe or, where no timeframe has been agreed, within a reasonable time.
Scarcity remains responsible for resolving delivery problems with the carrier until the order has been delivered to you, subject to applicable law.
Risk in the products passes to you when the products are delivered to the nominated address or collected by you.
## 13. Authority to leave
Where you provide authority for a courier to leave a parcel unattended, delivery may be treated as completed when the parcel is left at the authorised location in accordance with your instructions, to the extent permitted by law.
Consider whether the nominated location is secure before providing authority to leave.
## 14. Incorrect addresses and unclaimed parcels
Where an order is returned because:
* An incorrect or incomplete address was supplied.
* Delivery was refused.
* The parcel was not collected.
* The carrier could not complete delivery for a reason attributable to the recipient,
we may ask you to pay reasonable redelivery costs.
We will contact you before arranging redelivery or refunding the returned order. Any deduction from a refund will be limited to reasonable costs and will be made only where permitted by law.
## 15. International orders
International customers are responsible for checking local import requirements.
The recipient may be required to pay customs duties, taxes, brokerage fees or other import charges imposed by the destination country. These charges are not controlled by Scarcity and are not included unless expressly stated at checkout.
We are not responsible for delays caused by destination-country customs processes, but this does not limit any rights that cannot lawfully be excluded.
## 16. Returns, exchanges and faulty products
Returns and exchanges are governed by our Returns and Exchanges Policy.
For voluntary change-of-mind returns, products must be unworn, unused and unwashed, with all labels and tags attached, and returned in their original packaging.
These conditions do not limit your rights where a product is faulty, damaged, incorrectly described or otherwise fails to comply with the Consumer Guarantees Act 1993.
## 17. Promotions and discount codes
Unless stated otherwise:
* Promotions apply only during the advertised period.
* Discount codes must be entered before completing checkout.
* Only one discount code may be used per order.
* Discounts cannot be exchanged for cash.
* Promotions cannot be applied retrospectively to completed orders.
* Product exclusions and minimum-spend requirements may apply.
We will clearly communicate any material promotion-specific conditions.
Nothing in a promotion limits your rights under New Zealand consumer law.
## 18. Gift cards and store credit
Gift cards and store credit:
* May be used only through the channels specified when issued.
* Cannot normally be exchanged for cash unless required by law.
* Must not be resold or used fraudulently.
* Will not be replaced where lost or stolen unless required by law or the loss resulted from our error.
Any expiry date and additional conditions will be clearly stated when the gift card or credit is issued.
## 19. Intellectual property
All material on our website, including our brand name, logos, product designs, photographs, graphics, videos, written content and website layout, is owned by Scarcity or used with permission.
You may view and use the website for personal, non-commercial shopping purposes.
You must not reproduce, modify, distribute, sell, publish or commercially exploit our content without prior written permission, except where permitted by law.
## 20. Reviews and customer content
Where you submit a review, photograph, video, comment or other content to Scarcity, you confirm that:
* You created the content or have permission to submit it.
* The content is accurate and is not misleading.
* The content does not infringe another person’s rights.
* The content is not unlawful, defamatory, abusive or malicious.
You retain ownership of your content.
Where you separately authorise us to repost or use the content, you grant Scarcity a non-exclusive, royalty-free licence to use it for the agreed marketing or promotional purposes. We will not imply that you endorse Scarcity beyond the permission you have provided.
## 21. Third-party services and links
Our website may use or link to third-party services, including payment providers, social-media platforms and delivery tracking websites.
Third-party services are governed by their own terms and privacy policies. Scarcity is not responsible for third-party content or services outside our reasonable control.
## 22. Website availability
We aim to keep our website accurate, secure and available, but we do not guarantee uninterrupted or error-free access.
We may temporarily suspend access for maintenance, security or technical reasons.
Nothing in this section limits liability for a failure to exercise reasonable care or for any right that cannot be excluded under New Zealand law.
## 23. Liability
To the maximum extent permitted by law:
* Scarcity is not liable for loss caused by your misuse of a product, failure to follow care instructions or unauthorised alteration of a product.
* Scarcity is not liable for indirect or consequential loss that was not reasonably foreseeable.
* Each party remains responsible for loss caused by its own actions or failure to meet its legal obligations.
Nothing in these terms excludes or restricts liability where doing so would be unlawful, including liability arising under the Consumer Guarantees Act 1993 or Fair Trading Act 1986.
## 24. Events outside our reasonable control
We are not responsible for delay caused by events genuinely outside our reasonable control, such as natural disasters, major transport disruption, industrial action, governmental restrictions or widespread service outages.
We will take reasonable steps to minimise the effects of the event and communicate material delays.
If we cannot fulfil an order within a reasonable period, we may cancel the unfulfilled portion and provide an appropriate refund. This section does not remove any remedy available under applicable law.
## 25. Changes to these terms
We may update these Terms and Conditions from time to time.
Updated terms apply to future website use and future orders from the date they are published. The terms applying to an accepted order will generally be the version in effect when that order was placed, unless a change is required by law or agreed with you.
## 26. Severability
If any part of these terms is found to be invalid or unenforceable, the remaining provisions will continue to apply.
## 27. No waiver
A failure or delay by Scarcity in enforcing a provision does not waive our right to enforce it later.
## 28. Governing law
These Terms and Conditions are governed by the laws of New Zealand.
You and Scarcity submit to the non-exclusive jurisdiction of the New Zealand courts. This does not prevent a consumer from exercising any mandatory right available under another applicable law.
## 29. Concerns and disputes
Contact us first if you have a concern about an order or these terms. We will make reasonable efforts to resolve the matter fairly.
You may also have the right to seek assistance from New Zealand Consumer Protection, the Commerce Commission, the Disputes Tribunal or another appropriate body.
